Terms and Conditions

These Terms and Conditions ('Terms') govern your use of Lost and Found Concierge (the 'Site') and the services provided therein. By accessing or using the Site, purchasing a membership, or submitting a lost item report, you agree to be bound by these Terms.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE SITE.

1. Acceptance of Terms & Electronic Signature

By accessing the Site and clicking "I Accept," "Pay Now," or using any device to complete a transaction, you agree to comply with these Terms and all applicable laws. You agree that your digital acceptance constitutes a binding electronic signature, legally equivalent to your manual signature.

2. Nature of Service (Disclaimer)

It is vital that you understand the nature of the service you are purchasing:

  • Third-Party Service: Lost and Found Concierge is a private, third-party assistance service. We are not a lost and found department, custodian, or warehouse, and we do not maintain physical possession of lost items.
  • No Affiliation: We are not associated, affiliated, authorized, or endorsed by any airline, airport, the TSA, theme park, resort, ride share company, or other venue where you may have lost an item.
  • Convenience: You acknowledge that you may file lost item reports directly with venues on your own. You are electing to use our service solely for the convenience of having us handle the administrative filing process on your behalf.

3. Membership Tiers, Payment & Renewal

We offer two membership tiers. You agree to pay the fees associated with the tier selected at checkout:

A. TravelCare Concierge 60 Days (Standard)

  • Fee: One-time payment of $45.00.
  • Term: Valid for 60 days from the date of purchase.
  • Billing: This is a non-recurring charge.

B. TravelCare Concierge 365 Days (Annual Subscription)

  • Fee: Recurring payment of $159.00 per year.
  • Term: Valid for 365 days from the date of purchase.
  • Automatic Renewal: This membership automatically renews. You authorize us to charge your payment method $159.00 annually on the anniversary of your purchase until you cancel.
  • Cancellation of Auto-Renewal: You may cancel the auto-renewal feature at any time by emailing support@lostandfoundconcierge.com. Canceling auto-renewal stops future charges but does not refund the current active year.

4. Strict Refund & Cancellation Policy

Due to the immediate administrative labor involved in filing claims and contacting venues, we adhere to a strict refund policy.

  • 24-Hour Cancellation Window: You may cancel your membership and receive a full refund to your original form of payment only if you notify us via email within 24 hours of the transaction (initial purchase or renewal).
  • How to Cancel: Notification must be sent to support@lostandfoundconcierge.com.
  • No Refunds After 24 Hours: Under no circumstances will you be entitled to a refund if you fail to cancel within the 24-hour window.
  • No Refunds Based on Outcome: The fee is for the professional service of filing the claim. Dissatisfaction with the outcome of the search does not constitute grounds for a refund.

5. No Guarantees & Limitation of Scope

  • No Result Guarantee: THERE ARE NO GUARANTEES OF RECLAIMING LOST ITEMS. We file claims based on the information you provide and interact with custodians on your behalf, but we cannot control the internal processes, inventory, or efficiency of the venues.
  • Shipping Fees: Our membership fees cover administrative assistance only. Our fees do not include administrative, handling, pick-up, shipping, or storage fees charged by any venue. Any shipping fees, customs duties, or handling charges required to return a found item must be paid separately by you directly to the carrier or the holding venue.

6. User Conduct & Integrity

You agree to use the Site only for lawful purposes. You must not:

  • Violate any applicable local, state, or national laws.
  • Submit false or fraudulent lost item reports. You certify that the information provided regarding your lost item is true to the best of your knowledge.
  • Attempt to gain unauthorized access to the Site or use automated scripts/bots.

7. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is owned by Lost and Found Concierge or its licensors and is protected by copyright and trademark laws. You are granted a limited, non-exclusive license to use the Site for personal, non-commercial purposes.

8. Privacy and Data Protection

Our Privacy Policy governs the collection, use, and sharing of your personal data.

California Residents: Under the California Consumer Privacy Act (CCPA), you have specific rights regarding your personal information.

EU Residents: Under the General Data Protection Regulation (GDPR), you have rights regarding your personal data, including the right to access, rectify, or delete it.

9. Limitation of Liability

To the fullest extent permitted by law, Lost and Found Concierge shall not be liable for:

  • Any direct, indirect, incidental, or consequential damage arising out of your use of the Site.
  • The failure of any venue, airline, or custodian to locate or return your item.
  • Loss of profits, loss of data, or business interruption.

This limitation applies to the maximum extent permitted by applicable law, including California and EU laws.

10. Indemnification

You agree to indemnify, defend, and hold harmless Lost and Found Concierge, its affiliates, employees, and agents from any claims, damages, liabilities, and expenses (including legal fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

11. Third-Party Links

Our Site may include links to independent third-party websites or services that are not operated, controlled, or supervised by us. We make no representations or warranties regarding, and assume no liability for, the content, practices, privacy policies, or availability of any third-party websites or services.

12. Governing Law & Dispute Resolution

Governing Law

  • These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.

Dispute Resolution

  • California Residents: You may submit complaints to the California Department of Consumer Affairs.
  • EU Residents: You have the right to lodge a complaint with a supervisory authority in your country of residence.
  • Chargeback Waiver: By accepting these terms, you agree not to file a credit card dispute (chargeback) on the basis that your item was not found, provided we have performed the filing service as described.

13. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated date. Your continued use of the Site constitutes acceptance of the updated Terms.
